Terms of Service

Welcome to CityClaim.org (“CityClaim”, “we”, “us”, or “our”). These Terms of Service (“Terms”) are a binding agreement between you (“you”, “user”, or “customer”) and CityClaim that govern your access to and use of our website, applications, and services (collectively, the “Services”). By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. About CityClaim

CityClaim is a private, independent platform designed to help individuals and businesses prepare and submit administrative claims to cities, municipalities, and related agencies. CityClaim is not a law firm and does not provide legal advice, legal representation, or legal referrals. We offer document preparation, form completion, packaging, submission facilitation, status tracking, and related administrative support.

2. Eligibility & Account

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. If you use the Services on behalf of a business or another person, you represent that you have authority to bind that entity or person to these Terms. You are responsible for ensuring the information you provide is complete and accurate.

3. Authorization to Act

By submitting a claim through CityClaim, you authorize us to prepare and submit claim paperwork on your behalf using the information you provide, including a digital signature where accepted. You further authorize us to communicate with the relevant city, agency, or insurer for purposes of processing the claim and to share the documents and data you upload as needed to complete and transmit your claim.

4. No Legal Advice; No Attorney‑Client Relationship

All information provided by CityClaim is for informational and administrative purposes only. CityClaim does not provide legal advice or opinions, and no attorney‑client relationship is created by use of the Services. For legal questions, you should consult a licensed attorney.

7. Fees & Payment

Unless otherwise stated in writing, CityClaim uses a no‑win, no‑fee model for consumer claims: if your claim is denied or you receive no payment, you owe no success fee. If you receive payment, you agree to pay a success fee of 15% of the recovered amount (minimum $30). We may offer fixed‑fee or hybrid pricing for certain claim types or business services; any such pricing will be disclosed in advance for your approval. Payment processing may be handled by third‑party processors subject to their terms.

8. No Guarantee

CityClaim does not and cannot guarantee any outcome. Final decisions regarding approval, denial, and payment are made solely by the relevant agency, city, or insurer.

9. Communications & Notices

By using the Services, you consent to receive communications from us electronically (email, SMS, platform notifications). You agree that all communications we provide electronically satisfy any legal requirement that such communications be in writing.

We collect, use, and share personal information as described in our Privacy Policy. You grant CityClaim a limited license to process and transmit your content for the purpose of providing the Services. You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.

The Services may integrate or interact with third‑party services (e.g., email, e‑signature, payment, mailing). CityClaim is not responsible for third‑party services and makes no representations about them. Your use of those services is governed by their terms and policies.

13. Intellectual Property

All content and materials on the Services, including text, graphics, logos, and software, are owned by CityClaim or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. CITYCLAIM DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CITYCLAIM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. CITYCLAIM’S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE FEES ACTUALLY PAID BY YOU TO CITYCLAIM FOR THE SPECIFIC CLAIM AT ISSUE.

16. Indemnification

You agree to indemnify, defend, and hold harmless CityClaim and our officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your content, or your violation of these Terms.

17. Suspension & Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms, suspected fraud, or to comply with law. Upon termination, provisions that by their nature should survive will survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

18. Modifications

We may update these Terms from time to time. Changes are effective when posted to this page with an updated “Last Updated” date. Your continued use of the Services after changes become effective constitutes acceptance.

19. Governing Law & Venue

These Terms and any disputes arising out of or relating to them are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Tarrant County, Texas.
